The Ministry of Lands and Physical Planning published a draft National Rating Bill 2021 for stakeholder engagement. The Bill would repeal the Valuation for Rating Act of 1956 (Cap 266) and the Rating Act of 1963 (Cap 267), modernising the law on property rates in line with Article 209(3) of the Constitution of Kenya 2010, which empowers county governments to impose property taxes.

The Bill aims to bring harmony and equity to how counties levy property rates, while allowing each county to enact its own legislation within the national framework. It forms part of the Government's wider effort to boost county own-source revenue, following the Policy to Support Enhancement of County Governments' Own-Source Revenue approved by Cabinet in August 2018.

Together with colleagues at FSD Kenya, I contributed to FSD Kenya's comments on the draft Bill. The full submission is available from FSD Kenya.
